Litigation

Congressman Pallone, House Democrats, and Partners Launch Unprecedented Litigation Effort to Defend Constitutional Rights and Federal Law.

  • Led amicus brief to the Supreme Court defending Planned Parenthood, arguing that Medicaid recipients have a legal right to choose their own qualified health care provider, including providers like Planned Parenthood. (Case No. 23-1275 filed March 12, 2025)
  • Signed amicus brief and secured a preliminary injunction against the Trump Administration’s unlawful effort to dismantle the Consumer Financial Protection Bureau. (Case No. 1:25-cv-00381-ABJ filed February 28, 2025)
  • Helped lead amicus brief to reverse Donald Trump’s unlawful firing of members of the Federal Trade Commission in violation of long-standing legal precedent and the Constitution. (Case No. 25-cv-909-LLA filed April 14, 2025)
  • House Democrats sued to block Trump’s attempt to illegally seize control of elections by overriding state laws and denying eligible citizens the ability to vote. (Case 1:25-cv-00952 filed March 31, 2025)
  • Filed amicus brief defending Birthright Citizenship from Trump’s unconstitutional executive order in violation of the 14th Amendment and immigration law. (Case No. 2:25-cv-00127-JCC filed April 11, 2025)

Legislation

Congressman Pallone is leading the charge to pass legislation that defends our Constitution and asserts Congress’s authority.

  • Co-Sponsor of H.R. 1835, the MERIT Act, to reverse politically motivated mass firings of federal probationary employees defending the nonpartisan integrity of the civil service. (Introduced March 4, 2025)
  • Co-Sponsor of H.R.14, the John R. Lewis Voting Rights Advancement Act, to restore and strengthen federal protections against voting discrimination and enhance the ability to challenge discriminatory laws in court. (Introduced March 5, 2025)
  • Co-Sponsor of H.R.1877, the Protecting Americans’ Social Security Data Act, to prohibit political appointees and temporary government employees from accessing sensitive Social Security data and establish penalties for misuse. (Introduced March 5, 2025)
  • Co-Sponsor of H.R.1101, the Taxpayer Data Protection Act, to place strict limitations on who can access sensitive federal financial systems, preventing DOGE from misusing public payment systems for partisan purposes. (Introduced February 6, 2025)
  • Co-Sponsor of H.R.1876, the Keeping Our Field Offices Open Act, to prevent the closure of the Social Security field and hearing offices. (Introduced March 5, 2025)

Investigation

As the top Democrat on the Energy and Commerce Committee, Congressman Pallone is using his authority to investigate the Trump Administration and hold it accountable. 

  • Called on the Inspector General to investigate the Department of Energy's politically motivated targeting of Democratic states, which is an illegal partisan use of federal energy resources. (April 4, 2025)
  • Demanded documents and answers from HHS Secretary Robert Kennedy over the illegal firing of 10,000 workers leaving public health agencies dangerously understaffed. (April 1, 2025)
  • Launched investigation into Secretary Zeldin’s Efforts to steal taxpayers’ money from the Greenhouse Gas Reduction Fund. (March 11, 2025)
  • Started inquiry into the Federal Communications Commission's assault on the First Amendment and partisan attacks targeting media outlets critical of President Trump. (March 31, 2025)
  • Initiated probe into the mass firings at the Department of Energy and the EPA, which will drive up home electricity prices as well as threaten access to safe drinking water and clean air. (April 14, 2025)

Demanding Answers

Congressman Pallone and his fellow Democrats are uniting to demand answers for the outrageous actions of Donald Trump and his billionaire cabinet. 

  • House Democrats sent a letter demanding answers from the Acting CMS Administrator regarding the administration’s reckless purge of workers at the agency spearheaded by DOGE. (March 10, 2025)
  • Coalition of Democrats sent letter to President Donald Trump calling on him to end his administration’s use of detention for families and children of immigrants. (April 10, 2025)
  • Congressman Pallone wrote a letter to Education Secretary McMahon condemning Trump’s executive order to devastate public schools, especially for low-income and special needs students. (March 24, 2025)
  • Pallone sent letter to EPA Administrator Zeldin demanding compliance with court orders to release unlawfully frozen funds appropriated by Congress. (February 5, 2025)
  • Pallone led letter to Commerce Secretary Howard Lutnick demanding a reversal of illegal cuts to NOAA threaten public safety and weather alerts heading into hurricane season. (April 16, 2025)
